Client Waiver, Release of Liability & Service Agreement
1. Services
The Client authorizes the Service Provider to provide in-home pet sitting and/or house sitting services, which may include but are not limited to feeding, watering, litter box maintenance, administering medications as instructed, basic home care, and related services as agreed upon.
2. Assumption of Risk
The Client understands and agrees that pet care and house sitting involve inherent risks, including but not limited to:
Pet illness, injury, escape, or death that are not due to service providers negligence
Behavioral issues such as biting, scratching, or aggression
Property damage caused by the pet
Household hazards (plumbing, electrical, appliances, security systems)
Acts of third parties or unforeseen events
*Client knowingly and voluntarily assumes all such risks.
3. Release & Waiver of Liability
To the fullest extent permitted under California law, Client releases, waives, and discharges Service Provider, its owners, employees, contractors, and agents from any and all claims, liabilities, damages, losses, or expenses arising out of or related to the services provided, including but not limited to:
Injury, illness, loss, or death of Client’s pet(s)
Property damage to the Client’s home
Actions or behavior of the pet(s)
Delays, emergencies, or circumstances beyond the Service Provider’s control
This waiver applies to claims arising from ordinary negligence but does not apply to gross negligence, recklessness, or willful misconduct, as prohibited under California law.
4. California Civil Code §1542 Waiver
Client expressly waives the protections of California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Client acknowledges that this waiver applies to unknown or unsuspected claims.
5. Pet Health & Behavior Disclosure
Client certifies that:
All pets are current on core vaccinations, including Rabies, FVRCP and FeLV for cats. Canine Distemper (D), Canine Parvovirus (P), Canine Adenovirus / Infectious Hepatitis (A or H) for dogs.
All medical conditions, pre-existing diseases, medications, allergies, and behavioral issues have been fully disclosed
Pets do not pose a known safety risk unless disclosed in writing
Service Providers may discontinue services if a pet poses a safety concern.
*The owner is responsible for costs associated with undisclosed medical conditions or injuries caused by their pet to others.
6. Home Access, Security & Cameras
Client authorizes Service Provider to enter the home as needed to perform services and confirms that:
Access instructions are accurate
All security systems, alarms, and indoor or outdoor cameras have been disclosed
Service Provider is not responsible for security malfunctions or access issues beyond reasonable control
7. Additional Authorized Persons & Third-Party Access
Client agrees to disclose in writing any and all third parties who will have access to the property during the period of pet sitting or house sitting services, including but not limited to:
Housekeepers or cleaners
Contractors or repair personnel
Landscapers
Family members, roommates, or guests
Other pet care providers
No third party shall access the property during the service period without prior notice to and agreement by the Service Provider.
Client acknowledges and agrees that the Service Provider:
Is not responsible for the actions, negligence, or omissions of any third party
Is not liable for pet escape, injury, illness, property damage, or loss caused by third-party access
May refuse or discontinue services if undisclosed or unauthorized persons access the property
Client further agrees to indemnify and hold harmless the Service Provider from any claims, damages, losses, or expenses arising out of or related to third-party access to the property.
8. Property Damage
Service Provider is not responsible for:
Damage caused by pet(s), break-in and thief or any other third party other than the service provider.
Pre-existing household issues
Normal wear and tear
Power outage or water damage causing related issues
*Client agrees to reimburse Service Provider for damages resulting from undisclosed hazards or pet behavior.
9. Indemnification
Client agrees to defend, indemnify, and hold harmless Service Provider from any claims, damages, losses, or legal fees arising from:
Pet actions or behavior
Client’s failure to disclose relevant information
Claims brought by third parties related to the services
10. Photos & Updates
Client authorizes Service Provider to take photos/videos of pet(s) for care updates.
Marketing use is optional.
11. Governing Law & Venue
This Agreement shall be governed by the laws of the State of California, with venue in the county where the services are performed.
